General conditions of provision of the service
1. Type and scope of provision

em.me by Paolo Gardin commits itself to create custom-made jewels starting from the client’s requests and allowing the latter to participate in the various steps of production.

2. Methods of provision and mutual obligations

2.1 Contact phase and beginning of the process

The client undertakes to provide all the information necessary to develop the project of the jewel s/he desires, such as, but not limited to: any image, shape and colours required, ideas, favourite materials, indicative budget, measurements and lengths desired, receiving address of the finished item.

2.2 Graphic design phase

Once the information mentioned at 2.1 has been received, a draft of the project requested and the quotation related to that project with the indicated characteristics will be sent to the client, who, at this point, will not have any obligation to accept the offer.

The client will have 7 days from the receipt of draft and quotation to confirm his purchase order by signing and returning the quotation and the draft by email or certified email. if possible, and by paying the deposit of 20% of the quotation.

2.3 Colour project

Within 10 days, depending on the complexity of the jewel requested, the client will receive the colour project of the approved draft with detailed indications on measurements, materials, etc. Based on this project, linked to a serial number, the client can make small changes so that the jewel reflects his wishes more and more.

All changes must comply with the guidelines provided together with the draft. Any alteration not accounted for in the provided guidelines will entail the devising of an additional quotation to be submitted to the client for approval. The timing for the development of this phase depends on the client’s timely acceptance and on the complexity of any change requested.

2.4 3D prototyping phase

The 3D prototyping begins on the basis of indications and changes requested in the previously accepted phase. The client will receive a new draft within 40 days: the prototype will include the precise indication of measurements, the position of each gemstone and any detail so that the client can have a clear and thorough depiction of how the finished jewel will be. Even in this phase, further minor changes may be requested.

Once the 3D design phase has been completed, a final rendering will be presented to the client, which must be signed and returned for acceptance, proceeding with the payment of a further 30% of the quotation.

2.5 Manufacturing phase

This is the beginning of the actual manufacturing of the jewel, whose timing depends on its complexity. On average, it will take between 30 and 40 days.

Once the commissioned jewel has been created, the client will receive first a photo and the invoice, which s/he will proceed to pay within 7 days after receipt.

3. Guarantee

em.me jewels are provided with a guarantee certificate defining their characteristics and those of the materials deployed.

In case of a request for gems certified by recognised gemmological institutes, the relative certificate will be also provided.

The characteristics indicated in the certificate will be valid in case of disputes or return processes.

4. Intellectual property and confidentiality

The provision of the service is meant for the creation of a finished and real object; therefore, the intellectual property of models, drawings and projects sent to the client remains exclusive of em.me, who upholds the rights to use the different images for promotional or communication use both for online publication and in brochures or other printed material.

The publication of the story of the creation and manufacturing process, with the details of the client’s requests and wishes, will instead be subject to the client’s authorization. At any time and in any case, the protection of the client’s privacy and of his data will always be guaranteed, and they will be dealt according to the law.

5. Validity, payments and shipment

5.1 Validity

The currency used for quotations and payments is Euro. All quotations exclude any applicable VAT, and are valid for 7 days from the date on which they are sent to the client.

5.2 Payments

The payment terms are set as follows: 20% of the quotation upon the acceptance of both draft and quotation; 30% upon the acceptance of the final 3D render; 50% at the end of the manufacturing process, before the delivery.

The payment method is via bank wire transfer.

5.3 Shipment

The shipment will be via courier specialized in valuables to the address provided by the client. Shipping costs are included in the quotation, and they include mandatory insurance.

6. Right to withdraw

The client can exercise the right to cancel the contract, allowed for purchases made outside of any commercial premises. The client, in fact, may withdraw from the contract, without any fine and without giving any reason, within fourteen days from the date upon which s/he has received the products.

The intention to exercise the right to withdraw must be communicated by the client via registered mail together with the acknowledgment of the delivery received. The client must, within the same period of fourteen days, return the products to the sender and em.me by Paolo Gardin will refund the purchase price within five days after receipt of the returned items.

The returns shipping costs are charged to the client.

The purchase price will be refunded only if the jewel has not been deteriorated, damaged, or replaced – entirely or in parts – by the client and only if returned in the original package. For the conformity of the jewel and of the different parts, gemstones and materials, the guarantee certificate will prevail.

Any complaint or communication related to the manufactured item purchased must be made by registered mail with acknowledgment of receipt to be sent to the following address: 49 Avenue De La Princesse Le Vesinet 78110 (France).

The contract and all disputes arising out of its application and/or enforcement will be governed by the Italian law and subject to the exclusive jurisdiction of the Courts in Milan.
